Tillybell - Terms of Service

1. Overview

Welcome to Tillybell (also "we", "us", "our"). We operate the website tillybell.co.uk and supply the products listed on our site (the "Services"). By accessing our site and/or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Cookies Policy, and any additional policies referenced here or available by hyperlink.

Our store is hosted by Shopify Inc., which provides the e-commerce platform enabling us to sell products to you.

2. Eligibility & Your Account

You must be the age of majority in your jurisdiction to place an order. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Orders & Contract Formation

Your order is an offer to buy. We will confirm receipt by email; however, acceptance occurs only when we dispatch the product(s) and send a dispatch confirmation. We may reject or cancel any order (for example, due to stock issues, pricing errors, suspected fraud, or legal/regulatory reasons). If we cancel after payment, we will refund you in full.

4. Pricing, VAT & Availability

Prices are shown in GBP and include VAT where applicable. We may change prices at any time before acceptance of your order. Despite our best efforts, pricing/availability errors may occur. If we discover an error, we will contact you to confirm whether you wish to proceed at the correct price or cancel for a full refund.

5. Payment

We accept the payment methods shown at checkout. Payment is taken at order placement or on dispatch, depending on method. You promise that you are authorised to use the selected payment method and that details are accurate and valid.

6. Delivery, Risk & Title

Estimated delivery dates are guidance only. Risk in the products passes to you upon delivery to the address you provide. Title passes when we receive full payment. Please check parcels on arrival and notify us promptly of any issues.

7. Consumer Cancellations & Returns (UK/EU Consumers)

If you are a consumer, you may have a legal right to cancel under the Consumer Contracts Regulations 2013 within 14 days of delivery, subject to statutory exceptions (e.g., sealed goods not suitable for return due to health protection or hygiene reasons once unsealed). This is separate from our Returns Policy and our 30-Day Money Back Guarantee, which may provide additional rights.

To exercise the legal right to cancel, you must clearly inform us within 14 days of delivery and return the goods within a further 14 days. You are responsible for return costs unless we agree otherwise or the goods are faulty/misdescribed. We may deduct any loss in value caused by unnecessary handling.

8. Faulty or Misdescribed Goods

Your statutory rights under the Consumer Rights Act 2015 apply. If your item is faulty or not as described, contact us and we will repair, replace, or refund as required by law.

9. Product Information & Use

We take care to describe and photograph products accurately, but minor variations may occur (e.g., packaging/label updates). Always follow the instructions on product labels and on our website (including safety pages). Misuse voids any guarantee.

10. Promotions, Discounts & Gift Cards

Promotions and discount codes are subject to their stated terms, may be withdrawn at any time, and cannot be combined unless expressly allowed. Gift cards are non-refundable, cannot be exchanged for cash, and are valid for the period stated at purchase (or 12 months if not stated).

11. Wholesale & Business Customers

Wholesale or B2B purchases (including bulk orders) are subject to agreed minimum order quantities and pricing schedules provided by us. To the extent permitted by law, certain consumer protections do not apply to B2B sales. Our liability to business customers is limited as set out in Section 16.

12. Acceptable Use

You agree not to use the site or Services for unlawful purposes; not to upload malware or attempt to gain unauthorised access; not to infringe intellectual property or privacy rights; and not to harass, defame, or otherwise abuse others. We may suspend or terminate access for breach.

13. User Content, Reviews & Submissions

By submitting reviews, comments, or other content, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, modify and publish such content in any media, and you promise that you have the right to grant this licence and that your content is lawful and non-infringing. We may moderate or remove content at our discretion.

14. Intellectual Property

All content on the site (including text, graphics, logos, product names, photographs and code) is owned by or licensed to Tillybell and is protected by IP laws. "Tillybell" and associated marks may be trademarks or registered trademarks. You may not copy, redistribute or create derivative works without our prior written consent.

15. Third-Party Tools & Links

We may provide access to third-party tools and links "as is" and "as available" without warranties. We are not responsible for third-party sites, content, products or services. Use them at your own risk and review their terms and privacy policies.

16. Warranties & Liability

We provide the site and Services "as is" and "as available" to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Consumers: We are responsible for foreseeable loss and damage caused by us. We are not liable for loss or damage that is not foreseeable, for business losses, or for events outside our reasonable control.

Business/Wholesale Customers: To the maximum extent permitted by law, we exclude all implied conditions, warranties or terms; and we will not be liable for loss of profits, sales, business, revenue, data, or for any indirect or consequential loss. Our total liability arising under or in connection with the contract shall be limited to the amount paid for the product(s) giving rise to the claim.

17. Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, epidemic/pandemic, war, terrorism, labour disputes, transport or utility failures, supply-chain disruption, or governmental action.

18. Data Protection & Privacy

Your personal data is processed in accordance with UK data protection laws. Please read our Privacy Policy and Cookies Policy for details on how we collect and use your information.

19. Security

Payment data is encrypted in transit. You are responsible for safeguarding your account credentials and for promptly notifying us of any suspected unauthorised use.

20. Changes to the Services or Terms

We may update products, pricing, and these Terms from time to time. The version posted on our website at the time you place your order will apply to that order. Your continued use of the site after changes are posted constitutes acceptance.

21. Assignment

We may assign or transfer our rights and obligations under these Terms to another organisation. You may only assign your rights or obligations with our prior written consent.

22. No Waiver

Failure or delay by us to enforce a provision of these Terms does not constitute a waiver of that or any other provision.

23. Severability

If any provision is found unlawful, void or unenforceable, the remaining provisions remain in full force and effect. Where possible, the invalid provision shall be interpreted to best reflect the intent of the parties.

24. Entire Agreement

These Terms, together with the policies referenced herein, constitute the entire agreement between you and Tillybell regarding the Services and supersede all prior communications.

25. Third-Party Rights

No person other than you and Tillybell has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms.

26. Governing Law & Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident elsewhere in the UK/EU may benefit from mandatory consumer protections and bring claims in their local courts.
